Release of Liability, Assumption of Risk, and Indemnification Agreement
By registering for any Fork and Cork event, you agree to the following terms:
1. Participant has chosen to participate in Sponsor’s Fork and Cork events (“the Events”), which include (but are not limited to) wine tastings, wine pairing dinners and wine classes.
2. Recognizing that consuming wine includes consuming alcohol, and that drinking wine can result in impaired physical and mental control, impairment in the operation of vehicles, and possible adverse health effects:
(a) Participant acknowledges that travel to and from Events and consumption of alcohol inherently requires personal responsibility, self-control, and sound judgment; therefore, Participant assumes all risks and consequences that are or could be in any way related to (i) travel to and from Events, and (ii) attendance and participation in the Events. Participant assumes the risk of both foreseeable and unforeseeable risks and consequences.
(b) Participant releases Sponsor from all liability that at any time is or may be in any way related to (i) Participant’s attendance or participation in any or all of the Events and (ii) Sponsor’s sponsorship of the Events.
3. Consistent with Participant’s personal responsibility for Participant’s own acts, omissions, and conduct, Participant agrees to indemnify and hold Sponsor harmless at all times from all liability, costs, expenses, and damages of every nature that relate in any way to Participant’s own acts, omissions, and conduct that relate in any way to (i) Participant’s transportation to and from any and all Events, and (ii) Participant’s attendance at and participation in any and all Events.
4. Participant understands and acknowledges that this Agreement might affect Participant’s liability insurance coverage(s). Participant has personally investigated the insurance consequences of entering into this Agreement and knowingly enters into this Agreement with informed knowledge of those consequences.
5. Participant acknowledges that Participant is free to refuse to enter into this Agreement but, as a result of any such refusal, Participant is aware that Sponsor will not allow Participant (and any other person who declines to sign a similar agreement) to attend any or all Events. Participant also recognizes and appreciates that the consideration for this Agreement is not only Sponsor’s agreement to allow Participant’s attendance and participation in the Events but also (i) the personal benefits and enjoyment that Participant expects to receive by attendance and participation in the Events and (ii) the benefit to Participant by Sponsor’s requirement that all persons attending one or more Events must agree to these terms.
